1. Who these terms are with
This website and the Drift Bang game are operated and published by Drift Bang, 18 rue des Petites Écuries, 75010 Paris, France ("we", "us", "our"). "You" means anyone accessing the site. Our full publisher details are on the Legal notice page and our contact details are on the Contact page.
2. Acceptance and changes
By accessing this site or playing the game you agree to these terms, our Privacy Policy and our Cookie Policy. If you do not agree, please stop using the site.
We may change these terms — for example to reflect a change in the game, the law, or our practices. The revised version applies from the date shown at the top of this page, and continuing to use the site afterwards means you accept it. Changes are never applied retrospectively to something that has already happened.
3. Your licence to play
We grant you a personal, non-exclusive, non-transferable, revocable licence to access and play Drift Bang through a standard web browser for your own private, non-commercial entertainment. That licence lasts as long as you comply with these terms.
Playing requires a device with a modern browser and working WebGL graphics acceleration, plus an internet connection to load the page. Providing those is your responsibility and at your cost.
4. Acceptable use
You must not:
- copy, reproduce, mirror, sell, sub-licence, rent or otherwise commercially exploit the game or any part of this site without our prior written permission;
- decompile, reverse engineer or modify the game other than as Articles L.122-6 and L.122-6-1 of the French Intellectual Property Code expressly permit, or circumvent any technical restriction;
- embed the game in another website, application or advertisement, or present it as your own or as anyone else's work;
- use bots, scrapers, automated scripts or modified clients to interact with the site, or tamper with stored game state to misrepresent results;
- attempt to gain unauthorised access to any part of the site, its servers or connected infrastructure, or probe, scan or test its security without our written consent;
- introduce malware, or launch a denial-of-service or any other attack that damages or overloads the service;
- submit content through our contact form that is unlawful, defamatory, obscene, harassing, or that infringes anyone's rights, or use the form to send unsolicited marketing;
- use the site in any way that breaks applicable law, including Articles 323-1 and following of the French Criminal Code on offences against automated data processing systems.
Breaching this section may result in us blocking your access and, where the law has been broken, reporting the matter to the relevant authorities.
5. Price, and the absence of purchases
Drift Bang is provided free of charge. There are no in-game purchases, no subscriptions, no virtual currency, no loot boxes and no paid unlocks, so there is nothing to buy, cancel or refund. We will never ask you for payment details to play. If any website, app or person asks you to pay for Drift Bang, they are not acting for us — please tell us.
Because nothing is sold, no distance-selling contract is formed and the 14-day withdrawal period under Article L.221-18 of the French Consumer Code does not arise. If we ever introduce an optional paid feature, it will be governed by separate purchase terms presented before payment, including the statutory withdrawal information, and the free game described here will remain free.
6. Availability
We aim to keep the site available and working but we cannot guarantee uninterrupted or error-free access. We may suspend, withdraw, restrict or change all or part of the site, including the game, for maintenance, security, technical or business reasons. Where we can reasonably give notice of planned downtime, we will. The game is provided as an entertainment product and is not intended for any purpose where interruption would cause loss.
7. Intellectual property
All intellectual property rights in this website and in Drift Bang — including the source code, game design, mechanics, rendering engine, procedurally generated artwork and audio, stage names, text, layout, and the Drift Bang name and logo — belong to us or our licensors, and are protected by the French Intellectual Property Code and equivalent laws elsewhere. Nothing in these terms transfers any of those rights to you.
You may link to any page on this site provided you do so fairly, without damaging our reputation or implying an association or endorsement that does not exist. You may not frame the site on another website without permission.
Drift Bang is an original work of fiction. All vehicles, liveries, locations and stage names are invented. They are not affiliated with, endorsed by, sponsored by or licensed from any real vehicle manufacturer, place, event or brand, and any resemblance is coincidental. Any third-party names appearing incidentally on this site are the property of their owners and are used descriptively only. If you believe material on this site infringes your rights, email contact@driftbang.com with details of the material, your rights in it, and your contact details, and we will investigate promptly.
8. Your device and your data
The game runs on your device and saves your best score, campaign progress, unlocked cars and any racer profile to your browser's local storage. You are responsible for your own device, browser and settings. Clearing your browsing data deletes all of it, and because none of it is ever sent to us we cannot restore it. We are not responsible for loss of locally stored game progress or profiles.
How we handle personal data is set out in our Privacy Policy, which forms part of these terms.
9. Third-party links
Where we link to another website — for example the CNIL — we do so for information only. We do not control those sites, do not endorse their content, and accept no responsibility for them or for any loss arising from your use of them. Their terms and privacy policies apply once you leave our site.
10. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our fault, for fraud or fraudulent misrepresentation, for gross negligence (faute lourde) or wilful misconduct (faute dolosive), or for anything else that cannot lawfully be limited or excluded.
Subject to that paragraph, and because the game is supplied free of charge:
- the site and the game are provided "as is" and "as available", and we exclude all implied warranties and conditions to the fullest extent permitted by law;
- we are not liable for indirect or consequential loss, loss of profit, loss of business, loss of goodwill, loss of data, or loss of locally stored game progress;
- we are not liable for loss caused by a virus, denial-of-service attack or other harmful material that infects your device through your use of the site, or by your reliance on any information published on it;
- our total aggregate liability arising out of or in connection with the site and the game, on any legal basis whatsoever, is limited to 100 €.
This section does not affect the rights described in section 11.
11. Your rights as a consumer, and mediation
If you are a consumer, you keep all the statutory rights given to you by the French Consumer Code and by EU consumer law, including the conformity guarantee for digital content and services under Articles L.224-25-12 and following of the Consumer Code. Nothing in these terms affects those rights, and where any provision here conflicts with them, your statutory rights prevail.
If a complaint to us (section 13) has not been resolved to your satisfaction, you may refer the dispute free of charge to a consumer mediator under Articles L.612-1 and following of the Consumer Code, within one year of your written complaint. You may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. Please contact us and we will give you the current mediator's details.
12. Suspension of access
We may withdraw or suspend your access without notice if we reasonably believe you have breached section 4, or if it is necessary to protect the site, other users or our lawful interests. Where the breach is capable of being remedied and the circumstances allow, we will normally warn you first.
13. Complaints
If something has gone wrong, contact us at contact@driftbang.com or through our contact form. We acknowledge complaints within 3 working days and aim to resolve them within 15 working days, telling you if we need longer and why.
14. General
These terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between us regarding the site and the game. If any provision is found unenforceable, the rest continues in force. A delay in enforcing any provision is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor to our business, and this will not affect your rights.
15. Governing law and jurisdiction
These terms and any dispute arising out of them or their subject matter are governed by French law. If you are a consumer resident in the European Union, you keep the benefit of any mandatory consumer protections of the country where you live, and you may bring proceedings before the courts of that country as well as before the French courts.
